§ 44-2. Definitions.
The following words, terms, and phrases, when used in this chapter, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:
Alternative antenna support structure means manmade trees, clock towers, bell steeples, flag or light poles, and similar alternative-design mounting structures that camouflage or conceal the presence of antennas or antenna support structures. An alternative antenna support structure may have an antenna and be affixed to an existing building, overhead facilities, or the like.
Antenna means mounted exterior apparatus designed for the transmission and/or reception of telephonic, radio, television, or other wireless communications and/or data.
Antenna support structure means any structure designed and constructed primarily for the purpose of supporting one or more antennas, including, but not limited to, self-supporting lattice towers, guy towers, monopole towers, and alternative antenna support structures. The term is synonymous with the terms "structure" and "tower," and includes, but is not limited to, radio and television transmission towers, microwave towers, and common-carrier telephone towers.

Lattice tower. A telecommunications antenna support structure which consists of vertical and horizontal supports and metal crossed strips or bars to support an antenna and connecting appurtenances. The term "lattice tower" includes such towers that meet the aforementioned definition and which may or may not be supported by guy wires.

Monopole tower. A telecommunications antenna support structure consisting of a single pole to support an antenna and connecting appurtenances, and which is constructed with or without guy wires or ground anchors.
(3)
Guyed tower. Any variety of telecommunications antenna support structure that use wire guys connecting above grade portions of the structure diagonally with the ground to provide support for the structure, antennas, and/or connecting appurtenances.
Applicant means any provider or any person, partnership, or company who files an application for any permit necessary to install, maintain, or remove a telecommunications service facility within the county.
Board of commissioners means the board of commissioners of the county.
Building permits department means the county building permits department.
Collocation means the use of a common antenna support structure or common site by two or more telecommunications providers, or by one telecommunications provider for more than one antenna or for more than one type of an antenna or technology.
Comprehensive plan means a plan, as amended from time to time, devised to provide the county with a guide for future growth and development in accordance with the Georgia Planning Act.
Conditional zoning use or conditional use means a special use, normally prohibited by the county zoning ordinance, that must be:
(1)
Approved pursuant to articles XV and XVII of the county zoning ordinance;
(2)
Recommended by the planning commission; and
(3)
Approved by the commissioner.
County means Haralson County.
Equipment enclosure means a building or other structure, including, but not limited to, shelters, cabinets, or vaults used to house and/or store equipment used in the operation or maintenance of a telecommunications facility.
FAA means the Federal Aviation Administration.
FCC means the Federal Communications Commission.
Height means the distance measured vertically from the highest point when positioned for operation to the lowest point which is defined as the bottom of the base of the structure being measured at either roof or ground level, whichever is applicable. The height of a tower shall include the height of any antenna positioned for operation attached or which may be attached to the highest point on the tower.
Modification means the physical changing of any portion of a telecommunications facility from its description in a previously approved permit, including, but not limited to, structural design and physical appearance changes, but not necessarily technology upgrades.
Planning commission means the county planning commission.
Public property means any and all property owned or otherwise controlled by the county.
Telecommunications Act means the Telecommunications Act of 1996, 47 USC 151 et seq., as now and hereafter amended.
Telecommunications facility means that which is built, constructed, installed, or erected by or on behalf of a telecommunications provider for purposes providing or offering telecommunication services and which include as a part thereof a building, equipment enclosure, and/or antenna support structure.
Telecommunications service means the providing or offering for rent, sale, lease, or in exchange for other value received, of the transmittal of voice, data, image, graphic, video programming information, and wireless communications between or among points by wire, cable, fiber optics, laser, microwave, radio, satellite, or similar media with or without the benefit of any closed transmission medium.
Zoning appeals board means the county zoning appeals board.
Zoning ordinance means the county zoning ordinance adopted December 12, 2004, as amended, and which is set forth in chapter 50 of this Code.
